Terms of Service
These Terms of Service govern your use of the Promotionix website and your engagement with Promotionix for funnels, paid acquisition, conversion strategy, tracking, automation and related marketing services.
1. Services
Promotionix provides marketing and growth services that may include funnel strategy, landing pages, conversion copywriting, Meta Ads, tracking, lead capture, follow-up automation, optimization and related consulting or implementation. The exact scope, deliverables, timelines and fees are defined by the applicable proposal or agreement.
2. Client Responsibilities
- Provide accurate business, offer, product and audience information.
- Provide timely access to required websites, ad accounts, analytics, domains, CRM tools and other systems.
- Review and approve copy, creatives, pages and campaigns within reasonable timelines.
- Ensure that claims, offers, products, testimonials and promotional materials supplied by you are lawful and accurate.
- Maintain an appropriate advertising/media budget where paid traffic is part of the engagement.
3. Fees & Payments
Fees are based on the agreed scope. Setup fees, project fees, retainers or other charges may be payable in advance or according to the payment schedule stated in your proposal or invoice. Third-party costs such as advertising spend, software subscriptions, domains, hosting, payment gateway fees and platform charges are generally separate unless explicitly included.
4. Advertising & Performance
Marketing outcomes depend on many factors outside Promotionix's control, including offer-market fit, pricing, sales performance, audience demand, platform policies, competition, seasonality and media costs. We do not guarantee a specific number of leads, sales, revenue, ROAS, conversion rate or profit unless an explicit written agreement states otherwise.
5. Intellectual Property
Client-specific final deliverables that have been fully paid for may be used by the client for its business, subject to any third-party licenses. Promotionix retains ownership of its pre-existing frameworks, processes, templates, know-how, internal systems and reusable components unless otherwise agreed in writing.
6. Third-Party Platforms
Promotionix may work with platforms such as Meta, Google, YouTube, WhatsApp, email providers, CRM systems, payment processors and automation tools. Their availability, pricing, policies and decisions are outside Promotionix's control. We are not responsible for outages, account restrictions, policy enforcement or changes made by those platforms.
7. Confidentiality
Both parties should treat non-public business, commercial and technical information received during an engagement as confidential, except where disclosure is required by law or the information is already public.
8. Cancellation & Suspension
Either party may request cancellation according to the applicable proposal or agreement. Promotionix may suspend work when invoices are overdue, required access is unavailable, approvals are materially delayed, or continued work would create a legal, security or platform-policy concern.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Promotionix is not liable for indirect, incidental, consequential or speculative losses arising from the use of marketing services or third-party platforms. Any liability arising from a specific engagement will be subject to the terms agreed for that engagement and applicable law.
